WEBSITE TERMS OF USE

Effective from: 1 September 2026

§ 1. General provisions

  1. These Terms set out the rules for using the websites available at https://starmax.eu and https://starmax.com.pl (jointly the "Website") and the types, scope and conditions of the electronic services provided through the Website, in accordance with Art. 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services.
  2. The service provider and owner of the Website is Marek Starczewski, conducting business under the name STARMAX Marek Starczewski, registered in the Polish Central Register and Information on Economic Activity (CEIDG), ul. Rycerska 3, 83-050 Bąkowo, Poland, Tax ID (NIP): PL 562-160-28-50, REGON 320587109 (the "Provider" or "STARMAX").

  4. A "User" is any person using the Website. The services on the Website are addressed primarily to businesses, local authorities, educational institutions, housing associations and cooperatives, and designers; consumers may also use the Website.
  5. The Website is a catalogue and information service. No sales are conducted through the Website – the Website does not allow orders to be placed or payments to be made. Contracts for the sale, delivery and installation of STARMAX products are concluded outside the Website on the basis of individual offers and arrangements.

§ 2. Types and scope of electronic services

  1. The Provider provides the following free electronic services through the Website:
    1. browsing the Website content – product catalogue, projects, blog, information pages, and downloading the materials made available (catalogues, product sheets, CAD/SketchUp files, inspirations);
    2. forms – contact form, request for quote, catalogue order, meeting booking, request for a free design;
    3. User Account – allowing the User to save contact and address details, create a wishlist of products and submit enquiries more easily;
    4. Newsletter – periodic e-mails with information about STARMAX products, projects, news and promotions.
  2. The services referred to in item 1(a) and (b) are available without registration. Using the Account and the Newsletter requires providing the data indicated in the relevant form.

§ 3. Technical requirements

  1. To use the Website you need: a device with Internet access, a current version of a web browser (Chrome, Firefox, Safari, Edge or equivalent) with JavaScript and necessary cookies enabled, and – to use the Account, the Newsletter and the forms – an active e-mail account.
  2. The Provider endeavours to keep the Website running without interruption but reserves the right to temporary technical breaks for maintenance, updates or development of the Website.

§ 4. Rules of use

  1. The User must use the Website in accordance with the law, good practice and these Terms, respecting the rights of the Provider and third parties.
  2. The User is prohibited from providing unlawful content, in particular content infringing third-party rights, offensive or misleading content, and from taking actions that disrupt the operation of the Website (including sending unsolicited commercial communications, automated content scraping and attempts at unauthorised access).
  3. The User must provide true and up-to-date data in the forms. Providing a third party's data without their knowledge and consent is prohibited.
  4. Point of contact (Digital Services Act). For the purposes of Regulation (EU) 2022/2065 (Digital Services Act) the Provider designates the e-mail address info@starmax.eu as its single point of contact for communication with Member State authorities, the European Commission, the European Board for Digital Services and Users. Communication with the point of contact is possible in English and Polish.
  5. Reporting illegal content. The Website does not allow Users to publish content (reviews, comments). Should anyone nevertheless consider that the Website contains illegal content, they may report it to the point of contact, indicating the exact location (URL), the reasons and their contact details. The Provider acknowledges receipt of the report, processes it without undue delay in a non-arbitrary and objective manner, and informs the reporting party of its decision and of the possibility of challenging it through the complaint procedure (§ 9).

§ 5. User Account

  1. The contract for maintaining an Account is concluded when the User completes the registration form, accepts these Terms and clicks the registration button. The contract is concluded for an indefinite period and is free of charge.
  2. The User must keep their password confidential and must not share the Account with third parties. Any unauthorised use of the Account must be reported to the Provider immediately.
  3. The User may terminate the Account contract (delete the Account) at any time and without giving reasons – from the Account settings or by sending a request to the Provider's e-mail address. Deletion takes place without delay and no later than within 14 days.
  4. A User who is a consumer may withdraw from the Account contract within 14 days of its conclusion without giving reasons, by sending a statement to the Provider's e-mail address; as the service is free of charge, withdrawal involves no costs.
  5. The Provider may terminate the Account contract with 14 days' notice for important reasons, in particular where the User breaches § 4, and may delete an Account unused for more than 3 years after notifying the User by e-mail.

§ 6. Newsletter

  1. The Newsletter contract is concluded when the User provides an e-mail address in the subscription form (on the Website or when registering an Account) and consents to receiving commercial communications. The contract is free of charge and concluded for an indefinite period.
  2. The User may unsubscribe from the Newsletter at any time by clicking the unsubscribe link in the footer of each message, in the Account settings or by sending a request to the Provider's e-mail address.

§ 7. Forms, catalogue and quotes

  1. Submitting a form (contact, request for quote, catalogue order, meeting booking, design request) does not constitute placing an order or concluding a contract. The Provider responds to enquiries during business hours, as a rule within 2 business days.
  2. Product information on the Website – including photos, visualisations, descriptions, technical parameters and any indicative prices – is for information purposes only and does not constitute an offer within the meaning of Art. 66 of the Polish Civil Code, but an invitation to enter into a contract (Art. 71 of the Polish Civil Code). Binding terms, including price, lead time and the scope of delivery or installation, are set out each time in the Provider's individual offer.
  3. The colours and appearance of products in photos and visualisations may differ from the actual products due to screen settings and the available variants.
  4. A free concept design prepared at the User's request remains the Provider's intellectual property and is made available solely for the purpose of preparing a project using STARMAX products.

§ 8. Intellectual property and downloadable materials

  1. The content of the Website – texts, photos, visualisations, designs, logos, catalogues, product sheets, CAD/SketchUp files, graphic layout – is protected by copyright and industrial property rights and is owned by the Provider or its partners. The STARMAX name and product line names (including Poolbil™) are protected.
  2. Materials made available for download (catalogues, technical sheets, CAD/SketchUp files, inspirations) may be used solely for designing and planning projects using STARMAX products and in public procurement procedures concerning such products. Public distribution, modification for presentation as one's own work, use to offer other manufacturers' products and removal of authorship markings are prohibited.
  3. Any other use of the Website content, including copying photos and descriptions to other websites, requires the Provider's prior written consent.

§ 9. Complaints

  1. Complaints concerning the operation of the Website and the electronic services (Account, Newsletter, forms) may be submitted by e-mail to the Provider's address or in writing to the address given in § 1 item 2. A complaint should include data allowing the User to be identified and a description of the problem.
  2. The Provider handles complaints without delay and no later than within 14 days of receipt, replying to the address from which the complaint was sent unless the User indicates another means of contact.
  3. Complaints concerning STARMAX products (statutory warranty, guarantee) are handled under the terms of the sales contract and the guarantee document; information on the guarantee is available on the "Warranty" page of the Website.

§ 10. Liability

  1. The Provider is liable for the provision of electronic services under general principles. Towards Users who are not consumers, the Provider's liability arising from the use of the Website is limited to damage caused intentionally; the Provider is not liable to them for lost profits or for the consequences of using information from the Website in designs and procurement procedures without confirmation in an individual offer.
  2. The Provider is not responsible for the content of websites linked from the Website (including social media profiles).

§ 11. Personal data

The rules for processing Users' personal data and the use of cookies are set out in the Privacy and Cookie Policy available on the Website.

§ 12. Final provisions

  1. The Provider may amend these Terms for important reasons, in particular in the event of changes to the law, changes to the scope or manner of providing services (e.g. the launch of sales through the Website) or for security reasons. Users holding an Account or subscribed to the Newsletter will be notified of amendments by e-mail at least 14 days before they take effect. A User who does not accept the amendments may terminate the Account or Newsletter contract before that date.
  2. The provisions of these Terms concerning consumers also apply to a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person, as follows in particular from the subject of their business activity disclosed in the Polish CEIDG register.
  3. These Terms are available in Polish (starmax.com.pl) and English (starmax.eu). In the event of any discrepancy, the Polish version prevails.
  4. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services and the Consumer Rights Act. The choice of Polish law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  5. Disputes with Users who are not consumers are resolved by the court having jurisdiction over the Provider's registered office. Consumers may use out-of-court complaint and redress procedures, including through district (municipal) consumer ombudsmen and the Provincial Inspectorates of Trade Inspection in Poland; information is available at https://uokik.gov.pl.
